1. Service Introduction

Welcome to the Insta360+ Moments feature (hereinafter referred to as "this feature"). This feature utilizes artificial intelligence technology to provide you with intelligent editing, theme classification, and creative optimization services for panoramic videos. By using this feature, you are deemed to have read and agreed to all terms of this agreement.

Moments Pro is an advanced subscription service for the Moments feature and is available only to users who have activated Insta360+ Cloud Album. If you are subscribing to Moments Pro for the first time, we will provide you with a three (3)-month free trial beginning on the date of activation. No fees will be charged during the trial period. Each account is eligible for the free trial only once.Unless you cancel before the end of the free trial, your subscription will automatically renew when the trial expires, and you will be charged at the subscription price displayed to and accepted by you at the time of activation. Before each automatic charge, we will notify you of the charge date and amount through in-app notifications, the Apple App Store, Google Play, or other applicable channels.

Your subscription is managed by the third-party channel through which you subscribed, such as the Apple App Store or other app stores. You may cancel at any time through the relevant channel; the applicable cancellation steps and cancellation deadlines are governed by that channel’s rules. Following cancellation, you may continue to use the Moments feature until the end of the current subscription period, after which no further charges will be made. Cancelling your subscription or allowing it to expire will not affect your continued use of other Insta360+ Cloud Album services.

Please note that the smart editing, thematic categorisation, and creative enhancement services provided within the Moments feature are performed by artificial intelligence algorithms. Due to factors including the capabilities of the AI model and the image quality and shooting conditions of the materials you select, the edited videos, categorisation results, and enhancement effects may differ from actual circumstances or expectations. We will continue to refine our algorithms to improve service quality; however, to the extent permitted by law, we make no representation or warranty that any particular output will be accurate, complete, or fit for your particular purpose. You may adjust, regenerate, or delete the outputs yourself.

2. Data Processing and Storage

To deliver the Moments feature to you, we will employ artificial intelligence algorithms to analyze the materials you upload to the cloud (including videos and images) and their exif data/metadata (such as shooting time, location, and device model) for theme recognition, intelligent clip selection, scene editing, and title/cover generation. During this process, your materials may be shared with AI service providers. Please rest assured, your cloud materials will only be used for the aforementioned processing purposes and will not be utilized for training purposes.

If you wish to disable this feature, you can do so at any time via "Me > Settings > Moments".

In the course of providing the Feature, we will notify you through the phone number or email you provided in your Insta360 account to send you SMS or email notifications (e.g., when processing is completed). Such SMS or email notifications are strictly limited to service-related notifications directly associated with this Feature. If you prefer not to receive such notifications, you may disable them at any time via “Me > My Cloud Space > Cloud Album Permissions.”

3. Warrants and Authorization

(a) You warrant that you possess all legal rights to the uploaded materials or have obtained authorization from the rights holder; otherwise, you shall bear all consequences and losses arising therefrom;

(b) You grant Insta360 a non-exclusive, worldwide, royalty-free license to process the aforementioned data solely for the purpose of providing this feature.

(c) Please ensure that the content generated by this feature is used exclusively for your personal entertainment, learning, research, or appreciation, and not for any commercial purposes.

4. Friendly Reminder

You acknowledge and are aware that all content generated by the current service is produced by artificial intelligence models. Insta360+ makes no warranties as to the accuracy, completeness, or functionality of the generated content, which does not represent the attitudes or views of Insta360+. Insta360+'s services are derived from information accumulated in ways permitted by laws and regulations, including but not limited to the open internet, and have undergone continuous automatic and manual filtering for sensitive data. However, it cannot be ruled out that some information may contain flaws, be unreasonable, or cause discomfort.

If you encounter such situations, your supervision is welcomed and appreciated at any time through the methods provided on this platform. For contact information, please refer to the "Insta360+ User Agreement" and "Insta360+ Privacy Policy".

Unless otherwise stipulated in this statement, Insta360+ reserves the right to change, interrupt, or terminate the activity page based on business judgment.

5. This statement is an attachment to the "Insta360+ User Agreement" and "Insta360+ Privacy Policy", and has the same legal effect. In case of conflict, this statement shall prevail. For matters not mentioned herein, the "Insta360+ User Agreement" and "Insta360+ Privacy Policy" shall apply.
