Mechanics Terms and Conditions

By entering the giveaway you agree that you are at the age of majority under applicable laws and regulations, have a valid passport and that you have read and agreed to the below Terms and Conditions.

1. The Promoter

The promoter is: PUBITY GROUP LTD of 20 Dale Street Manchester England M1 1EZ.

2. The giveaway

2.1 The title of the giveaway is “Insta360 x Pubity Giveaway.”

3. How to enter

3.1 The giveaway period commences on the 12 August at 3:00pm (the "Opening Time") and concludes on the 19 August at 3:00pm (the “Closing Time”), 2024 (UTC+1).

3.2 All giveaway entries must be received by the Promoter by no later than the Closing Time. All giveaway entries received after the Closing Time are automatically disqualified.

3.3 To enter the giveaway:

(a) You must follow @insta360 and @pubity on Instagram by the Closing Time.

(b) Like the post and tag a at least x1 friend in the post’s comments by closing time.

3.4 No purchase necessary and there is no charge to register.

3.5 The Promoter will not accept:

(a) responsibility for giveaway entries that are lost, mislaid or delayed in transit, regardless of cause, including, for example, as a result of any equipment failure, technical malfunction, systems, satellite, network, server, computer hardware or software failure of any kind; or

(b) screenshots of follow, likes or comments as proof of receipt of entry to the giveaway.

3.6 By submitting a giveaway entry, you are agreeing to be bound by these terms and conditions.

3.7 The winners will be picked from the comments that let us know what they love about the 360 camera. The winners must follow both @Insta360 and @Pubity on Instagram. The winners will be informed via Instagram within 3 days of the Closing Time and must respond within 3 days to claim their prize.

3.8 The name of the winner may be used for publicity purposes.

4. Eligibility

4.1 The giveaway is only open to all aged of majority (those aged over 18) at the Closing Time with a valid Passport, except:

(a) employees of the Promoter and the Supplier or their holding or subsidiary companies;

(b) employees of agents or suppliers of the Promoter or its holding or subsidiary companies, who are professionally connected with the giveaway or its administration; or

(c) members of the immediate families or households of (a) and (b) above.

(d) any individuals with previous and/or current criminal convictions or any form of criminal record.

4.2 In entering the giveaway, you confirm that you are eligible to do so and eligible to claim the prize. The Promoter may require you to provide proof that you are eligible to enter the giveaway.

4.3 The Promoter will not accept giveaway entries that are:

(a) automatically generated by computer;

(b) completed by third parties or in bulk;

(c) illegible, have been altered, reconstructed, forged or tampered with;

(d) photocopies and not originals; or

(e) incomplete.

4.4 There is no limit of entries to the giveaway per person. Entries on behalf of another person will not be accepted and joint submissions are not allowed.

4.5 The Promoter reserves all rights to disqualify you if your conduct is contrary to the spirit or intention of the prize giveaway.

5. The Prize

5.1 The prizes available to win are: 2 Insta360 X4 (Standalone Bundle, includes 1x Standard Lens Guards, does not include memory card), and 2 Insta360 X3 (Standard Bundle includes 1x Insta360 X3, does not include memory card) for 4 giveaway winners. Each winner shall be eligible to win one prize.

5.2 The Prize shall be received by yourself and used in a proper way as indicated in the Product Brochure. You will be solely responsible for any loss, damage, personal injury or death occurring as a result of improper use of the prize.

5.3 Prizes are subject to availability. There is no cash alternative for the prize. The prize is not negotiable or transferable.

5.4 The prize is supplied by Insta360 (the "Supplier"), courtesy of Pubity Group. The Supplier reserves the right to replace the prize with an alternative prize at the Suppliers sole discretion.

5.5 The prize is strictly subject to the prize terms and conditions determined by the Promoter and Supplier.

5.6 In order to claim the prize the winner must respond to the direct message @pubity will send to the Instagram account used by the winner to enter the giveaway. The Promoter will provide the winner with an email address for the relevant contact at the Supplier who once contacted by the winner shall provide the winner with the prize directly.

6. Winners

6.1 The decision of the winner is final and no correspondence or discussion will be entered into regarding the decision or appealing the decision.

6.2 The Promoter will contact the winner as soon as practicable after the Announcement Date, using the Instagram account provided with the giveaway entry. The Promoter will not amend any contact information once the giveaway entry form has been submitted.

6.3 The Promoter must either publish or make available information that indicates that a valid award took place. To comply with this obligation the Promoter will publish the surname and county of major prize winner and, if applicable, their winning entry as a story post on @pubity (Announcement Date).

7. Claiming the prize

7.1 If you are the winner of the prize, you will have 3 calendar days from the Announcement Date to claim the prize by providing your email address and providing the information requested from the Promoter. If you do not claim the prize by this date, your claim will become invalid.

7.2 The prize may not be claimed by a third party on your behalf.

7.3 The Promoter will make all reasonable efforts to contact the winner. If the winner cannot be contacted or is not available, or has not claimed their prize within 3 calendar days of the Announcement Date, the Promoter reserves the right to offer the prize to the next eligible entrant selected from the correct entries that were received before the Closing Date.

7.4 The Promoter does not accept any responsibility if you are not able to take up the prize.

8. Limitation of liability

Insofar as is permitted by law, the Promoter, its agents or distributors and the Supplier, its agents or distributors will not in any circumstances be responsible or liable to compensate the winner or accept any liability for any loss, damage, personal injury or death occurring as a result of taking up the prize except where it is caused by the negligence of the Promoter or the Supplier, its agents or distributors or that of their employees. Your statutory rights are not affected.

9. Data protection and publicity

9.1 The Promoter will only process your personal information as set out in the privacy policy on www.pubitygroup.com. See also condition 6.3, with regard to the announcement of winner.

9.2 The Supplier will only process your personal information as set out in the privacy policy on www.insta360.com.

10. General

10.1 If there is any reason to believe that there has been a breach of these terms and conditions, the Promoter may, at its sole discretion, reserve the right to exclude you from participating in the giveaway.

10.2 The Promoter reserves the right to hold void, suspend, cancel, or amend the prize giveaway where it becomes necessary to do so.

10.3 These terms and conditions are governed by English law. If any entrants to this promotion wish to take court proceedings, then they must do this within the courts in the United Kingdom.
