1 Basic Information

This transparency declaration applies to the connected product and the related services identified below. It covers the product and service configuration made available in the European Union and European Economic Area as of the effective date stated in this declaration.Effective date of this declaration: 2026/9/11

2.1 Information on your terms of use

Use of Insta360 products and software services is subject to your acceptance of User Service Agreement and Privacy Policy . By installing, accessing or using this service, you indicate your agreement to be bound by these terms.

2.2 Information on the quality of the service

Service availability

The products are designed to remain available and perform stably under specified conditions, including response time, processing capability, connectivity, and accuracy. Actual performance may vary depending on power supply, configuration, network, environment, electromagnetic interference, and other factors. Temporary degradation or interruption may occur due to maintenance, updates, faults, or external service outages, and may differ from test condition specifications.

Performance characteristics

Actual performance may vary depending on payload, battery condition, temperature,errain, communication environment, operating mode, and other external factors. Performance specifications stated in the product documentation are generally based on defined test conditions and should not be interpreted as guaranteed performance under all operating environments.

Support and issue reporting

Technical and customer support are available to assist with product-related issues. Users may report issues through designated channels and are encouraged to provide product model, software/firmware version, issue description, connected device information, error messages, and relevant logs or screenshots. Issues will be handled based on nature and severity, with corrective measures including operational guidance, troubleshooting, updates, repair, or replacement.

Limitations

Product availability and performance are subject to technical, environmental, operational, and compatibility limitations, including storage capacity, hardware/software compatibility, and external systems. Certain functions depend on third-party services; changes or interruptions to such services may affect related functions. Users should operate the products in accordance with applicable manuals, specifications, and safety instructions. Actual performance varies by product model, configuration, operating environment, and usage conditions.

2.3 Purpose of data processing

Insta360 processes the product data and related service data described in this declaration for the purposes necessary to provide, operate and maintain the connected products and their related services, to ensure their security and stability, and to comply with applicable legal and regulatory obligations. For the detailed purposes of processing personal data, please refer to Privacy Policy.

3 Information on how the user can request that the data be made available

Data sharing requests

Under applicable data-access regulations, the user has the right to request that Insta360 make available the product data or related service data generated by the user's use of the Insta360 products.

Users can request access by sending an email to dataact@insta360.com or by completing Data Request Form.

Response time

Upon verification of the request, the data will be prepared and provided within 30 days in a structured, commonly used format (e.g., JSON, XML, CSV).

Scope of available data

Insta360 can make available only those categories of data that it lawfully obtains or can lawfully retrieve from the product or related services. Data stored exclusively on the product, the controller, the user's mobile device or removable storage and not transmitted to or stored by Insta360 may not be accessible to Insta360.

4 Information on how the user can request that the data is shared with a third party

Data sharing requests

The user may request that the data holder share available product data or related service data with a third party selected by the user.Users may share data with third parties by sending an email to dpocontact@insta360.com or completing Data Request Form.

User-selected recipients

Insta360 does not endorse or assume liability for the actions or policies of user-selected third-party recipients. The user acknowledges that once data is shared with a third party at the user's request, Insta360 no longer controls the processing of that data by the recipient.

Revocation

The user may revoke a request for future data sharing at any time by contacting Insta360 through the channels identified above. Revocation will take effect within a reasonable period and will not affect data already transmitted prior to receipt of the revocation.

5 Right to lodge a complaint

Users have the right to lodge a complaint with a competent supervisory authority if they consider that the processing of their data by Insta360 infringes applicable data-protection or data-access regulations.

Under Article 38 of the EU Data Act, you have the right to lodge a complaint with the competent authority designated pursuant to Article 37 of the EU Data Act in the Member State of your habitual residence, place of work or establishment, if you consider that your rights under Chapter II of the Data Act have been infringed.

6 Information on trade secrets

Certain data generated by, or relating to Insta360 products may constitute trade secrets or confidential business information of Insta360 or its licensors.

These may include, but are not limited to:

  • proprietary algorithms, firmware architecture and software source code;
  • detailed diagnostic and performance data that reveal the internal functioning or security mechanisms of the product;
  • non-public product-development data and roadmaps; and
  • aggregated or anonymised data used for commercial analytics.

Insta360 takes reasonable measures to protect trade secrets and confidential information in accordance with applicable law. Where data requested by the user contains trade secrets, Insta360 may:

  • redact or withhold the specific information constituting a trade secret, provided that the user is informed of the reason for the redaction;
  • provide the data in a format that preserves the confidentiality of the trade-secret elements; or
  • refuse to disclose the data to the extent permitted by law, where disclosure would seriously harm Insta360's legitimate economic interests.

7 The duration of the contract between the user and the prospective data holder

The contractual relationship between the user and Insta360 arises from the acceptance of the terms of use applicable to the Insta360 products and the Insta360 App continues for the duration of the user’s use of the related services.

Certain data-processing activities may continue even if the user ceases active use of the related services, for example:

  • where Insta360 is required by law to retain records;
  • where data is retained for security, fraud-prevention or product-safety purposes; or
  • where the user has not formally closed their account or requested deletion of their data.

8 The arrangements for terminating such a contract

You may use Insta360 services at any time unless you or Insta360 terminate the service. To delete your Insta360 account, visit the Official Website > Account > Change Password > Delete My Account. In the Insta360 app, go to Account Settings > Delete Account to end your account.

Note: If you delete your account, you will lose access to other Insta360 or third-party products and services configured via that account. This action may be irreversible.
